Following up on the post about Royal Decree 775\/1997<\/a> on the employer’s obligations regarding Personal Protective Equipment and its most relevant articles, in the next one we will go deeper into a topic we left unfinished: the obligation to inspect PPE for work at height.<\/p>\n\n

Let’s start by talking about the inspection of PPE for work at height, which standard governs it, the changes it has undergone over time, and finally, the obligations manufacturers must meet.<\/p>\n\n

Inspection of PPE for Work at Height<\/strong><\/h2>\n\n

Inspections of work-at-height equipment, including the safety harness, are mandatory under the regulations set out in Royal Decree 1215\/97. Article 3 establishes the employer as the party responsible for taking the necessary maintenance measures so that work equipment is kept in good condition throughout its period of use, always following the manufacturer’s instructions.<\/p>\n\n

The same principle is carried over in RD 773\/97, which establishes in Article 7 that use, maintenance, cleaning, and disinfection must be in accordance with the instructions provided by the equipment manufacturer.<\/p>\n\n

In addition to these regulations, which set a certain common criterion that the person in charge of the equipment must maintain it in accordance with the manufacturer’s instructions, there are the evident recommendations that this type of equipment be in optimal, tested condition throughout its entire service life.<\/p>\n\n

UNE EN 365<\/strong><\/h2>\n\n

The standard that applies to this equipment and defines the inspection conditions most precisely is UNE-EN 365:2005: Personal protective equipment against falls from a height. General requirements for instructions for use, maintenance, periodic examination, repair, marking and packaging<\/em>. This standard is a reference both in construction and civil engineering and in wind energy maintenance standards<\/a>, where work at height on wind turbines demands rigorous, periodic checks of all the PPE used.<\/p>\n\n

Section 4.4 of that standard states the following:<\/p>\n\n

    \n
  1. A warning to stress the need for regular periodic inspections<\/strong>, and that users’ safety depends on the continued effectiveness and durability of the equipment.\n
      \n
    • A recommendation on the <\/span>frequency of periodic inspections<\/strong>, taking into account factors such as legislation, type of equipment, frequency of use, and environmental conditions. The recommendation must include a statement that the frequency of periodic inspection must be at least every 12 months.<\/span><\/li>\n\n\n\n
    • A warning to stress that periodic inspections may only be carried out by persons competent to do so<\/strong> and strictly following the manufacturer’s periodic inspection procedures.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n

      Thus, the standard determines that inspections must be carried out every year, or even more often if the manufacturer so specifies<\/strong>.<\/p>\n\n

      As we have seen in previous posts, the effective protection of PPE depends on its compliance with Regulation 425\/2016, which is why we have decided to include a summary of the changes this regulation brings, so that this post is as complete as possible for the reader.<\/p>\n\n

      Changes in the New Regulation 2016\/425 for PPE for Work at Height<\/strong><\/h2>\n\n

      The new regulation places greater responsibilities on manufacturers, distributors, importers, notified bodies, and authorities, with the aim of strengthening the safety of the PPE circulating on the market.<\/p>\n\n

      EU-type Examination Certificates will have a maximum validity of 5 years. In this way, users can be sure that the conformity of the PPE they use will be examined regularly, and if the product has been modified, or if the state of the art or the standards used to test conformity evolve, the product will be assessed again.<\/p>\n\n

      Changes in the Categories of PPE for Work at Height<\/strong><\/h2>\n\n

      The new regulation raises the category of some PPE to level III, such as those that address the risk of drowning (life jackets were previously category II) and harmful noise (previously category II).<\/p>\n\n

      Remember that level three means serious risk to health. For PPE for work at height there are no changes; it continues to be classified as category III (EU-type examination (module B) and module C2 or module D).<\/p>\n

      Certification of PPE for Work at Height Under the New Regulation (EU) 2016\/425<\/strong><\/h2>\n\n

      The new regulation imposes new requirements for marking and for the information that must be provided to the user.<\/p>\n\n

      In addition to the usual safety markings such as pictograms or the performance level, PPE must carry the name or trademark and the address of the manufacturer and of the importer. If there is no space on the product, this must appear on the data sheet or the packaging.<\/p>\n\n

      For products subject to aging (textile\/helmet), the date of manufacture (month\/year) must appear on the product and the packaging<\/p>\n\n

      The CE marking undergoes no change; the only novelty is seen in PPE that moves to category III, which must now carry the reference number of the notified body that performs the annual CE quality control.<\/p>\n\n

      The PPE data sheet must describe the risk the product is intended to protect against and refer to PPE Regulation 2016\/425, and it must give the web address where the declaration of conformity can be consulted; otherwise, the manufacturer must supply the EU declaration with the equipment.<\/p>\n\n

      What Are the Obligations of Manufacturers of PPE for Work at Height?<\/strong><\/h2>\n\n

      Manufacturers must provide the necessary technical documentation, the EU declaration of conformity to type, and the EU Type Certificate.<\/p>\n\n

      Technical documentation<\/strong><\/p>\n\n

      The complete description of the PPE and its intended use (it is essential to include foreseeable and unforeseeable uses), or an assessment of the risks the PPE must protect against.<\/p>\n\n

      Declaration of Conformity (EU Declaration of Conformity to Type).<\/strong><\/p>\n\n

      It must accompany the PPE or be available for download online.<\/p>\n\n

      CE Certificate (EU Type Certificate).<\/strong><\/p>\n\n

      Valid for 5 years. The manufacturer must keep this documentation for 10 years from the date the PPE is placed on the market.<\/p>\n\n

      In addition, the manufacturer will ensure its traceability and its link to the associated documentation by identifying itself as the manufacturer (stating name, trademark, and postal contact address) and by identifying the product (type, batch, or serial number).<\/p>\n\n

      In conclusion, in this post we have reviewed the mandatory inspections that must be carried out on PPE for work at height, which standard specifies the requirements, and what changes it has undergone over time.<\/p>\n\n
